Frequently Asked Questions about Divorce Mediation in San Bernardino and Los Angeles Counties

Do parties who engage in a divorce mediation process also need to retain a family law attorney or divorce attorney to represent them?

While some clients choose to hire attorneys to review their settlement agreement (known as a Memorandum of Understanding in mediation) or provide legal advice throughout the mediation process, there is no requirement in Los Angeles or San Bernardino Counties that parties retain a lawyer as involving attorneys is a matter of personal choice.

We find approximately 95% of Equitable Mediation clients choose not to involve attorneys in their divorce.


Is there confidentiality in mediation much like there is in an attorney-client relationship?

This is a tough one as the answer is, “it depends.”

Yes, there is confidentiality in mediation, but in light of recent discussions here in California, that confidentiality provision may be weakened when attorneys are present during the mediation and there is a claim of misconduct being made against one of the attorneys.

The good news is that we are Los Angeles divorce mediators and not attorneys and when using our mediation process, no attorneys are present. So in our view, the recent discussions regarding confidentiality will have no impact on our divorce mediation process.


What’s the difference between a Memorandum of Understanding (MOU) and a Marital Settlement Agreement (MSA)?

In mediation, a neutral third party mediator will draft what’s known as a Memorandum of Understanding (MOU) which contains all of the agreements the parties made with regards to items that affect their family such as custody, child support, and property division.

The agreements outlined in the MOU are then formally drafted into a legally binding document known as the Martial Settlement Agreement (MSA), which is signed by the parties and is one of the (many) documents that are submitted to the court to finalize the parties' divorce.

Depending on the Los Angeles divorce mediators you work with, your MOU may either need to be entirely rewritten costing you more in time and expense, or if you work with us, your MOU can be easily converted into your MSA, saving you time and money in the process.


What kind of divorce mediation training is necessary for divorce mediators? Los Angeles and San Bernardino Counties don’t seem to have any requirements for who can be a divorce mediator!

Currently there are no mediation training requirements for those wishing to practice divorce mediation in Los Angeles or San Bernardino Counties.

That means anyone (and I mean anyone) can call themselves divorce mediators in Los Angeles.

It’s not uncommon for attorneys to call themselves a “divorce mediation lawyer” or a “mediation attorney” as they feel passing the bar also qualifies them to be divorce mediators. But in our opinion, litigating or advocating for one party is an entirely different skillset than acting as a neutral third party and assisting both parties towards resolution.
