Should NJ Adopt an Alimony Formula?

As you may know from reading this website, the NJ Child Support Guidelines are used to determine the minimum amount of child support the parties must each pay in order to support their child but no such guidelines exist for alimony in New Jersey. Instead we have a series of “statutory factors” which quite frankly when you read them, don’t really tell you a whole lot about what the amount will be. That being said you may think that I’m in favor of guidelines for alimony in NJ but I have to admit, I am not. In this NJ divorce mediator’s opinion, people come to mediation to make their own decisions and not have some formula hosted upon them by the State of NJ. When was the last time the government of New Jersey did something and you said to yourself “wow! that was terrific! What a great thing they did!” Never would be my guess…

When you come to mediation I want both of you to feel empowered to make the decisions that are right in your particular case. As adults I beleive you should have the right to negotiate an alimony number that’s right in your case and not have one dictated to you but that’s just me. What do you think?
