Full Disclosure in Good Faith Divorce Mediation
For new clients of Equitable Mediation Services, the process of gathering the requisite documentation to prepare for their divorce mediation can seem quite extensive but it’s important to understand that it’s not just busy work but the foundation for your future. During divorce mediation sessions, we engage in what we call a “good faith” negotiation meaning we ask each of you to provide the documentation needed in order to help you both make informed decisions as what you present to each other will serve as the foundation for your financial future. Commonly in most households, one spouse is more familiar with the finances than the other so this discovery process allows each party to have access to documentation they might not otherwise have had. Naturally you both reserve the right to go to court, file a Case Information Statement, hire a Forensic Accountant and go broke in the process trying to sort through your real financial situation but in our experience, it’s just easier to follow a simple rule and that is: if we ask for it, we need it. By doing so, you’ll keep the process on track, costs down and allow each of you to come to an equitable distribution for each feel is fair.
