Do You Really Want To Go To Court?
Even under the best of circumstances such as when a couple is using a NJ divorce mediation service such as our, divorce is still an emotional topic. As a NJ divorce mediator, there are times when I witness what I call “brinksmanship” in which one party pushes the conversation to the edge of disaster in order to gain the best possible advantage or settlement for themselves. And while this might be an effective tactic in perhaps a hostile corporate takeover or a military battle, when it comes to divorce mediation, not so much. The one thing I hear people say when this happens is “fine then take me to court!” but let’s think through that statement.
Do you really want to go to court?
Do you really want to wait two to three years to resolve your divorce?
Do you really want to spend upwards of $100,000 each to come to the exact same settlement you could have come to in mediation in less time and at a fraction of the cost?
Something tells me the answer to these questions and others like it is absolutely not! I know it’s not easy but when something like that happens, perhaps it’s best to take a break, go to your neutral corners and think about how that scenario would play out.
