Are Divorce Mediation Agreements Binding?
As a NJ divorce mediator it’s my job to help couples work through their differences and come to agreements in the four major areas of mediation as listed under our “About Divorce Mediation” section, ultimately ending up with a Memorandum of Understanding the parties can use as the terms of their divorce. So you might then be wondering: are divorce mediation agreements binding? The answer? Not until the parties make them so – which is a terrific advantage for divorce mediation.
You see in today’s horrific economy, many couples are choosing to delay the ultimate filing of their divorce yet they want some sort of agreement that outlines the basic rules of the road that outline how they’ll operate until such time when they divorce. New Jersey does not have legal separation so the Memorandum of Understanding (the fancy name for the divorce mediation agreement) can be used as guidance on how to operate in the meantime as well as serve as the instructions how the parties will proceed once a formal divorce is entered with the courts once again, providing you and your spouse the control you want, need and deserve regarding the terms of your divorce.
